Terms and Conditions for the Use of the Ashley Discord Application
These Terms and Conditions (the "Terms", the "ToS", or the "Agreement") set forth the terms upon which the Rogue Army gaming community ("RGA", "We", "Us", or "Our") makes available the Ashley Discord application (the "Bot" or "Ashley") to Discord users who interact with it (each, a "User" or "You").
These Terms are to be read in conjunction with, and are supplemented by, the Ashley Privacy Policy and the Rogue Army Community Rules, each of which is incorporated herein by reference.

The current version supersedes any and all prior versions of these Terms. A summary of amendments is retained in §22 (Version History).
1. Interpretation and Definitions
1.1 Definitions
In these Terms, unless the context otherwise requires, capitalised terms shall bear the meanings ascribed to them in the Ashley Privacy Policy. In addition, the following terms shall bear the following meanings:
- "Agreement" means these Terms, the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference herein.
- "Force Majeure Event" bears the meaning ascribed to it in §17.
- "Indemnified Parties" bears the meaning ascribed to it in §16.
- "Intellectual Property Rights" means all rights in and to patents, utility models, trademarks, service marks, trade and business names (including goodwill), registered designs, unregistered design rights, copyrights (including rights in computer software), database rights, rights in know-how, and all other intellectual property rights or similar or equivalent rights anywhere in the world, whether registered or unregistered, and applications for any of the foregoing.
- "Service" means the functionality made available to Users by means of Ashley, as described in §3 below.
1.2 Construction
Headings are inserted for convenience only and shall not affect construction. Words in the singular include the plural and vice versa. References to any statute, regulation, or instrument include any amendment, re-enactment, or replacement thereof.
2. Acceptance and Binding Effect
2.1 Acceptance
By interacting with Ashley in any manner, including without limitation by invoking a slash command, triggering an automated response, or being present in a channel where Ashley monitors activity, You acknowledge that You have read, understood, and accepted these Terms and agree to be bound by them. If You do not agree to these Terms, You must cease all interaction with Ashley.
2.2 Capacity
You represent and warrant that You have the legal capacity to enter into these Terms and, if acting on behalf of an entity, that You have authority to bind that entity.
2.3 Scope
These Terms govern only Your use of Ashley within the Rogue Army Discord server. They do not extend to other bots, applications, or services operated by any third party, nor to any other Discord server.
3. Description of the Service
3.1 Features
Ashley provides, inter alia, the following features:
- Activity Tracking — monitoring of User engagement and voice channel activity for the operation of the Levelling System;
- Support Systems — ticketing and user-support functionality;
- AFK Management — automatic detection and management of away-from-keyboard status;
- Game Integration — integration with third-party gaming services to enhance the Community experience;
- AI-Powered Features — limited AI-assisted functionality for improved User interaction;
- Moderation Assistance — automated tools made available to authorised Community Administrators and Moderators.
3.2 Evolution of Features
The Community reserves the right, in its sole discretion, to add, modify, suspend, or remove any feature of Ashley at any time, with or without notice and without liability to any User.
4. Eligibility
4.1 Minimum Age
You must satisfy the minimum age required by Discord's Terms of Service in Your jurisdiction of habitual residence, and in no event be less than thirteen (13) years of age, to use Ashley. Certain features reserved for Users aged eighteen (18) or over are identified in the Community Rules and related instruments.
4.2 Compliance
You must at all times comply with Discord's Terms of Service, the Community Rules, applicable law, and these Terms. A material breach of any of the foregoing shall constitute a material breach of these Terms.
5. Licence to Use the Bot
5.1 Grant
Subject to Your compliance with these Terms, the Community grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to interact with Ashley solely for Your personal, non-commercial use within the Rogue Army Discord server.
5.2 Reservation of Rights
All rights not expressly granted herein are reserved to the Community. No licence is granted to the source code, binaries, configuration, or underlying infrastructure of Ashley.
6. Acceptable Use
You agree that Your use of Ashley shall at all times be:
- in accordance with these Terms, the Community Rules, Discord's Terms of Service, and all applicable laws and regulations;
- conducted with respect toward other Community members;
- limited to the features made available to You in Your capacity as a User;
- accompanied by prompt reporting of any bug, vulnerability, or security issue discovered to the Community Administrators through the channels set forth in §19.7.
7. Prohibited Use
You shall not, and shall not permit any third party to:
- (a) exploit, hack, reverse-engineer, decompile, or disassemble Ashley, in whole or in part, save to the extent that such restriction is prohibited by applicable mandatory law;
- (b) use Ashley for any unlawful, fraudulent, or unauthorised purpose;
- (c) interfere with or disrupt the operation of Ashley, its underlying infrastructure, or the Rogue Army Discord server;
- (d) probe, scan, or test the vulnerability of Ashley without the express prior written consent of the Community;
- (e) use Ashley to transmit malware, spam, or any other harmful code;
- (f) use any automated means (including bots, scripts, or scrapers) to interact with Ashley save those expressly sanctioned by the Community;
- (g) impersonate any person or entity, or misrepresent Your affiliation with any person or entity, in connection with Your use of Ashley;
- (h) harass, intimidate, or threaten other Users through Ashley's features;
- (i) attempt to circumvent, disable, or otherwise interfere with any security-related or access-control feature of Ashley;
- (j) collect, harvest, or aggregate Personal Data relating to other Users;
- (k) use Ashley in any manner that, in the Community's reasonable judgment, brings the Community or Ashley into disrepute.
8. User Content and Feedback
8.1 Content Submitted via Ashley
To the extent that You submit any content through or in connection with Ashley (including command parameters, ticket correspondence, and voluntarily submitted information), You represent and warrant that You have all necessary rights to do so and that such content does not infringe the rights of any third party.
8.2 Feedback
You may from time to time provide suggestions, comments, or ideas concerning Ashley ("Feedback"). You hereby grant the Community a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence to use, modify, implement, and otherwise exploit such Feedback for any purpose, without obligation of attribution or compensation. You waive any moral rights in the Feedback to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
The Processing of Personal Data in connection with Ashley is governed by the Ashley Privacy Policy, which is hereby incorporated by reference. By accepting these Terms, You acknowledge that You have had the opportunity to review the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.
10.2 No Endorsement; No Liability
The Community makes no representation or warranty in respect of any third-party service and shall not be liable for any act, omission, outage, data loss, or other conduct of any such third-party provider. Your dealings with third-party providers are solely between You and them.
11. Intellectual Property Rights
11.1 Ownership
All Intellectual Property Rights in and to Ashley, including without limitation its source code, compiled code, graphics, configuration, documentation, and all derivative works thereof, vest in and shall remain the sole and exclusive property of the Community (or its licensors, as applicable).
11.2 Restrictions
Save as expressly permitted by these Terms or by applicable mandatory law, You shall not copy, modify, adapt, translate, publish, distribute, sell, rent, lend, lease, sublicense, or create derivative works based upon Ashley or any part thereof.
11.3 Third-Party Marks
All trademarks, service marks, trade names, and logos appearing in connection with Ashley are the property of their respective owners.
12. Service Availability; No Service Levels
12.1 "As Available"
Ashley is provided on an "as available" basis. The Community does not warrant that Ashley will be available at any particular time, that it will operate without interruption, or that it will be free from errors or defects.
12.2 Maintenance
The Community may perform scheduled or unscheduled maintenance on Ashley at any time. The Community shall endeavour, where reasonably practicable, to announce scheduled maintenance in the Rogue Army Discord server, but shall not be obliged to do so.
12.3 No SLA
Nothing in these Terms shall be construed as the grant of any service-level commitment, uptime guarantee, or similar undertaking.
13. Suspension and Termination
13.1 Suspension by the Community
The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:
- Community Support Server: https://dc.roguearmy.xyz
- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

23. Acknowledgement
By continuing to interact with Ashley, You acknowledge that You have read, understood, and agreed to be bound by these Terms, together with the Ashley Privacy Policy and the Rogue Army Community Rules.

In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.

13. Suspension and Termination
13.1 Suspension by the Community
The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:

- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

Terms and Conditions for the Use of the Ashley Discord Application
These Terms and Conditions (the "Terms", the "ToS", or the "Agreement") set forth the terms upon which the Rogue Army gaming community ("RGA", "We", "Us", or "Our") makes available the Ashley Discord application (the "Bot" or "Ashley") to Discord users who interact with it (each, a "User" or "You").
These Terms are to be read in conjunction with, and are supplemented by, the Ashley Privacy Policy and the Rogue Army Community Rules, each of which is incorporated herein by reference.

The current version supersedes any and all prior versions of these Terms. A summary of amendments is retained in §22 (Version History).
1. Interpretation and Definitions
1.1 Definitions
In these Terms, unless the context otherwise requires, capitalised terms shall bear the meanings ascribed to them in the Ashley Privacy Policy. In addition, the following terms shall bear the following meanings:
- "Agreement" means these Terms, the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference herein.
- "Force Majeure Event" bears the meaning ascribed to it in §17.
- "Indemnified Parties" bears the meaning ascribed to it in §16.
- "Intellectual Property Rights" means all rights in and to patents, utility models, trademarks, service marks, trade and business names (including goodwill), registered designs, unregistered design rights, copyrights (including rights in computer software), database rights, rights in know-how, and all other intellectual property rights or similar or equivalent rights anywhere in the world, whether registered or unregistered, and applications for any of the foregoing.
- "Service" means the functionality made available to Users by means of Ashley, as described in §3 below.
1.2 Construction
Headings are inserted for convenience only and shall not affect construction. Words in the singular include the plural and vice versa. References to any statute, regulation, or instrument include any amendment, re-enactment, or replacement thereof.
2. Acceptance and Binding Effect
2.1 Acceptance
By interacting with Ashley in any manner, including without limitation by invoking a slash command, triggering an automated response, or being present in a channel where Ashley monitors activity, You acknowledge that You have read, understood, and accepted these Terms and agree to be bound by them. If You do not agree to these Terms, You must cease all interaction with Ashley.
2.2 Capacity
You represent and warrant that You have the legal capacity to enter into these Terms and, if acting on behalf of an entity, that You have authority to bind that entity.
2.3 Scope
These Terms govern only Your use of Ashley within the Rogue Army Discord server. They do not extend to other bots, applications, or services operated by any third party, nor to any other Discord server.
3. Description of the Service
3.1 Features
Ashley provides, inter alia, the following features:
- Activity Tracking — monitoring of User engagement and voice channel activity for the operation of the Levelling System;
- Support Systems — ticketing and user-support functionality;
- AFK Management — automatic detection and management of away-from-keyboard status;
- Game Integration — integration with third-party gaming services to enhance the Community experience;
- AI-Powered Features — limited AI-assisted functionality for improved User interaction;
- Moderation Assistance — automated tools made available to authorised Community Administrators and Moderators.
3.2 Evolution of Features
The Community reserves the right, in its sole discretion, to add, modify, suspend, or remove any feature of Ashley at any time, with or without notice and without liability to any User.
4. Eligibility
4.1 Minimum Age
You must satisfy the minimum age required by Discord's Terms of Service in Your jurisdiction of habitual residence, and in no event be less than thirteen (13) years of age, to use Ashley. Certain features reserved for Users aged eighteen (18) or over are identified in the Community Rules and related instruments.
4.2 Compliance
You must at all times comply with Discord's Terms of Service, the Community Rules, applicable law, and these Terms. A material breach of any of the foregoing shall constitute a material breach of these Terms.
5. Licence to Use the Bot
5.1 Grant
Subject to Your compliance with these Terms, the Community grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to interact with Ashley solely for Your personal, non-commercial use within the Rogue Army Discord server.
5.2 Reservation of Rights
All rights not expressly granted herein are reserved to the Community. No licence is granted to the source code, binaries, configuration, or underlying infrastructure of Ashley.
6. Acceptable Use
You agree that Your use of Ashley shall at all times be:
- in accordance with these Terms, the Community Rules, Discord's Terms of Service, and all applicable laws and regulations;
- conducted with respect toward other Community members;
- limited to the features made available to You in Your capacity as a User;
- accompanied by prompt reporting of any bug, vulnerability, or security issue discovered to the Community Administrators through the channels set forth in §19.7.
7. Prohibited Use
You shall not, and shall not permit any third party to:
- (a) exploit, hack, reverse-engineer, decompile, or disassemble Ashley, in whole or in part, save to the extent that such restriction is prohibited by applicable mandatory law;
- (b) use Ashley for any unlawful, fraudulent, or unauthorised purpose;
- (c) interfere with or disrupt the operation of Ashley, its underlying infrastructure, or the Rogue Army Discord server;
- (d) probe, scan, or test the vulnerability of Ashley without the express prior written consent of the Community;
- (e) use Ashley to transmit malware, spam, or any other harmful code;
- (f) use any automated means (including bots, scripts, or scrapers) to interact with Ashley save those expressly sanctioned by the Community;
- (g) impersonate any person or entity, or misrepresent Your affiliation with any person or entity, in connection with Your use of Ashley;
- (h) harass, intimidate, or threaten other Users through Ashley's features;
- (i) attempt to circumvent, disable, or otherwise interfere with any security-related or access-control feature of Ashley;
- (j) collect, harvest, or aggregate Personal Data relating to other Users;
- (k) use Ashley in any manner that, in the Community's reasonable judgment, brings the Community or Ashley into disrepute.
8. User Content and Feedback
8.1 Content Submitted via Ashley
To the extent that You submit any content through or in connection with Ashley (including command parameters, ticket correspondence, and voluntarily submitted information), You represent and warrant that You have all necessary rights to do so and that such content does not infringe the rights of any third party.
8.2 Feedback
You may from time to time provide suggestions, comments, or ideas concerning Ashley ("Feedback"). You hereby grant the Community a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence to use, modify, implement, and otherwise exploit such Feedback for any purpose, without obligation of attribution or compensation. You waive any moral rights in the Feedback to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
The Processing of Personal Data in connection with Ashley is governed by the Ashley Privacy Policy, which is hereby incorporated by reference. By accepting these Terms, You acknowledge that You have had the opportunity to review the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.
10.2 No Endorsement; No Liability
The Community makes no representation or warranty in respect of any third-party service and shall not be liable for any act, omission, outage, data loss, or other conduct of any such third-party provider. Your dealings with third-party providers are solely between You and them.
11. Intellectual Property Rights
11.1 Ownership
All Intellectual Property Rights in and to Ashley, including without limitation its source code, compiled code, graphics, configuration, documentation, and all derivative works thereof, vest in and shall remain the sole and exclusive property of the Community (or its licensors, as applicable).
11.2 Restrictions
Save as expressly permitted by these Terms or by applicable mandatory law, You shall not copy, modify, adapt, translate, publish, distribute, sell, rent, lend, lease, sublicense, or create derivative works based upon Ashley or any part thereof.
11.3 Third-Party Marks
All trademarks, service marks, trade names, and logos appearing in connection with Ashley are the property of their respective owners.
12. Service Availability; No Service Levels
12.1 "As Available"
Ashley is provided on an "as available" basis. The Community does not warrant that Ashley will be available at any particular time, that it will operate without interruption, or that it will be free from errors or defects.
12.2 Maintenance
The Community may perform scheduled or unscheduled maintenance on Ashley at any time. The Community shall endeavour, where reasonably practicable, to announce scheduled maintenance in the Rogue Army Discord server, but shall not be obliged to do so.
12.3 No SLA
Nothing in these Terms shall be construed as the grant of any service-level commitment, uptime guarantee, or similar undertaking.
13. Suspension and Termination

Terms and Conditions for the Use of the Ashley Discord Application
These Terms and Conditions (the "Terms", the "ToS", or the "Agreement") set forth the terms upon which the Rogue Army gaming community ("RGA", "We", "Us", or "Our") makes available the Ashley Discord application (the "Bot" or "Ashley") to Discord users who interact with it (each, a "User" or "You").
These Terms are to be read in conjunction with, and are supplemented by, the Ashley Privacy Policy and the Rogue Army Community Rules, each of which is incorporated herein by reference.

The current version supersedes any and all prior versions of these Terms. A summary of amendments is retained in §22 (Version History).
1. Interpretation and Definitions
1.1 Definitions
In these Terms, unless the context otherwise requires, capitalised terms shall bear the meanings ascribed to them in the Ashley Privacy Policy. In addition, the following terms shall bear the following meanings:
- "Agreement" means these Terms, the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference herein.
- "Force Majeure Event" bears the meaning ascribed to it in §17.
- "Indemnified Parties" bears the meaning ascribed to it in §16.
- "Intellectual Property Rights" means all rights in and to patents, utility models, trademarks, service marks, trade and business names (including goodwill), registered designs, unregistered design rights, copyrights (including rights in computer software), database rights, rights in know-how, and all other intellectual property rights or similar or equivalent rights anywhere in the world, whether registered or unregistered, and applications for any of the foregoing.
- "Service" means the functionality made available to Users by means of Ashley, as described in §3 below.
1.2 Construction
Headings are inserted for convenience only and shall not affect construction. Words in the singular include the plural and vice versa. References to any statute, regulation, or instrument include any amendment, re-enactment, or replacement thereof.
2. Acceptance and Binding Effect
2.1 Acceptance
By interacting with Ashley in any manner, including without limitation by invoking a slash command, triggering an automated response, or being present in a channel where Ashley monitors activity, You acknowledge that You have read, understood, and accepted these Terms and agree to be bound by them. If You do not agree to these Terms, You must cease all interaction with Ashley.
2.2 Capacity
You represent and warrant that You have the legal capacity to enter into these Terms and, if acting on behalf of an entity, that You have authority to bind that entity.
2.3 Scope
These Terms govern only Your use of Ashley within the Rogue Army Discord server. They do not extend to other bots, applications, or services operated by any third party, nor to any other Discord server.
3. Description of the Service
3.1 Features
Ashley provides, inter alia, the following features:
- Activity Tracking — monitoring of User engagement and voice channel activity for the operation of the Levelling System;
- Support Systems — ticketing and user-support functionality;
- AFK Management — automatic detection and management of away-from-keyboard status;
- Game Integration — integration with third-party gaming services to enhance the Community experience;
- AI-Powered Features — limited AI-assisted functionality for improved User interaction;
- Moderation Assistance — automated tools made available to authorised Community Administrators and Moderators.
3.2 Evolution of Features
The Community reserves the right, in its sole discretion, to add, modify, suspend, or remove any feature of Ashley at any time, with or without notice and without liability to any User.
4. Eligibility
4.1 Minimum Age
You must satisfy the minimum age required by Discord's Terms of Service in Your jurisdiction of habitual residence, and in no event be less than thirteen (13) years of age, to use Ashley. Certain features reserved for Users aged eighteen (18) or over are identified in the Community Rules and related instruments.
4.2 Compliance
You must at all times comply with Discord's Terms of Service, the Community Rules, applicable law, and these Terms. A material breach of any of the foregoing shall constitute a material breach of these Terms.
5. Licence to Use the Bot
5.1 Grant
Subject to Your compliance with these Terms, the Community grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to interact with Ashley solely for Your personal, non-commercial use within the Rogue Army Discord server.
5.2 Reservation of Rights
All rights not expressly granted herein are reserved to the Community. No licence is granted to the source code, binaries, configuration, or underlying infrastructure of Ashley.
6. Acceptable Use
You agree that Your use of Ashley shall at all times be:
- in accordance with these Terms, the Community Rules, Discord's Terms of Service, and all applicable laws and regulations;
- conducted with respect toward other Community members;
- limited to the features made available to You in Your capacity as a User;
- accompanied by prompt reporting of any bug, vulnerability, or security issue discovered to the Community Administrators through the channels set forth in §19.7.
7. Prohibited Use
You shall not, and shall not permit any third party to:
- (a) exploit, hack, reverse-engineer, decompile, or disassemble Ashley, in whole or in part, save to the extent that such restriction is prohibited by applicable mandatory law;
- (b) use Ashley for any unlawful, fraudulent, or unauthorised purpose;
- (c) interfere with or disrupt the operation of Ashley, its underlying infrastructure, or the Rogue Army Discord server;
- (d) probe, scan, or test the vulnerability of Ashley without the express prior written consent of the Community;
- (e) use Ashley to transmit malware, spam, or any other harmful code;
- (f) use any automated means (including bots, scripts, or scrapers) to interact with Ashley save those expressly sanctioned by the Community;
- (g) impersonate any person or entity, or misrepresent Your affiliation with any person or entity, in connection with Your use of Ashley;
- (h) harass, intimidate, or threaten other Users through Ashley's features;
- (i) attempt to circumvent, disable, or otherwise interfere with any security-related or access-control feature of Ashley;
- (j) collect, harvest, or aggregate Personal Data relating to other Users;
- (k) use Ashley in any manner that, in the Community's reasonable judgment, brings the Community or Ashley into disrepute.
8. User Content and Feedback
8.1 Content Submitted via Ashley
To the extent that You submit any content through or in connection with Ashley (including command parameters, ticket correspondence, and voluntarily submitted information), You represent and warrant that You have all necessary rights to do so and that such content does not infringe the rights of any third party.
8.2 Feedback
You may from time to time provide suggestions, comments, or ideas concerning Ashley ("Feedback"). You hereby grant the Community a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence to use, modify, implement, and otherwise exploit such Feedback for any purpose, without obligation of attribution or compensation. You waive any moral rights in the Feedback to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
The Processing of Personal Data in connection with Ashley is governed by the Ashley Privacy Policy, which is hereby incorporated by reference. By accepting these Terms, You acknowledge that You have had the opportunity to review the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.
10.2 No Endorsement; No Liability
The Community makes no representation or warranty in respect of any third-party service and shall not be liable for any act, omission, outage, data loss, or other conduct of any such third-party provider. Your dealings with third-party providers are solely between You and them.
11. Intellectual Property Rights
11.1 Ownership
All Intellectual Property Rights in and to Ashley, including without limitation its source code, compiled code, graphics, configuration, documentation, and all derivative works thereof, vest in and shall remain the sole and exclusive property of the Community (or its licensors, as applicable).
11.2 Restrictions
Save as expressly permitted by these Terms or by applicable mandatory law, You shall not copy, modify, adapt, translate, publish, distribute, sell, rent, lend, lease, sublicense, or create derivative works based upon Ashley or any part thereof.
11.3 Third-Party Marks
All trademarks, service marks, trade names, and logos appearing in connection with Ashley are the property of their respective owners.
12. Service Availability; No Service Levels
12.1 "As Available"
Ashley is provided on an "as available" basis. The Community does not warrant that Ashley will be available at any particular time, that it will operate without interruption, or that it will be free from errors or defects.
12.2 Maintenance
The Community may perform scheduled or unscheduled maintenance on Ashley at any time. The Community shall endeavour, where reasonably practicable, to announce scheduled maintenance in the Rogue Army Discord server, but shall not be obliged to do so.
12.3 No SLA
Nothing in these Terms shall be construed as the grant of any service-level commitment, uptime guarantee, or similar undertaking.
13. Suspension and Termination
13.1 Suspension by the Community
The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:
- Community Support Server: https://dc.roguearmy.xyz
- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

By continuing to interact with Ashley, You acknowledge that You have read, understood, and agreed to be bound by these Terms, together with the Ashley Privacy Policy and the Rogue Army Community Rules.

In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.

The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:

- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

Terms and Conditions for the Use of the Ashley Discord Application
These Terms and Conditions (the "Terms", the "ToS", or the "Agreement") set forth the terms upon which the Rogue Army gaming community ("RGA", "We", "Us", or "Our") makes available the Ashley Discord application (the "Bot" or "Ashley") to Discord users who interact with it (each, a "User" or "You").
These Terms are to be read in conjunction with, and are supplemented by, the Ashley Privacy Policy and the Rogue Army Community Rules, each of which is incorporated herein by reference.

1. Interpretation and Definitions
1.1 Definitions
In these Terms, unless the context otherwise requires, capitalised terms shall bear the meanings ascribed to them in the Ashley Privacy Policy. In addition, the following terms shall bear the following meanings:
- "Agreement" means these Terms, the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference herein.
- "Force Majeure Event" bears the meaning ascribed to it in §17.
- "Indemnified Parties" bears the meaning ascribed to it in §16.
- "Intellectual Property Rights" means all rights in and to patents, utility models, trademarks, service marks, trade and business names (including goodwill), registered designs, unregistered design rights, copyrights (including rights in computer software), database rights, rights in know-how, and all other intellectual property rights or similar or equivalent rights anywhere in the world, whether registered or unregistered, and applications for any of the foregoing.
- "Service" means the functionality made available to Users by means of Ashley, as described in §3 below.
1.2 Construction
Headings are inserted for convenience only and shall not affect construction. Words in the singular include the plural and vice versa. References to any statute, regulation, or instrument include any amendment, re-enactment, or replacement thereof.
2. Acceptance and Binding Effect
2.1 Acceptance
By interacting with Ashley in any manner, including without limitation by invoking a slash command, triggering an automated response, or being present in a channel where Ashley monitors activity, You acknowledge that You have read, understood, and accepted these Terms and agree to be bound by them. If You do not agree to these Terms, You must cease all interaction with Ashley.
2.2 Capacity
You represent and warrant that You have the legal capacity to enter into these Terms and, if acting on behalf of an entity, that You have authority to bind that entity.
2.3 Scope
These Terms govern only Your use of Ashley within the Rogue Army Discord server. They do not extend to other bots, applications, or services operated by any third party, nor to any other Discord server.
3. Description of the Service
3.1 Features
Ashley provides, inter alia, the following features:
- Activity Tracking — monitoring of User engagement and voice channel activity for the operation of the Levelling System;
- Support Systems — ticketing and user-support functionality;
- AFK Management — automatic detection and management of away-from-keyboard status;
- Game Integration — integration with third-party gaming services to enhance the Community experience;
- AI-Powered Features — limited AI-assisted functionality for improved User interaction;
- Moderation Assistance — automated tools made available to authorised Community Administrators and Moderators.
3.2 Evolution of Features
The Community reserves the right, in its sole discretion, to add, modify, suspend, or remove any feature of Ashley at any time, with or without notice and without liability to any User.
4. Eligibility
4.1 Minimum Age
You must satisfy the minimum age required by Discord's Terms of Service in Your jurisdiction of habitual residence, and in no event be less than thirteen (13) years of age, to use Ashley. Certain features reserved for Users aged eighteen (18) or over are identified in the Community Rules and related instruments.
4.2 Compliance
You must at all times comply with Discord's Terms of Service, the Community Rules, applicable law, and these Terms. A material breach of any of the foregoing shall constitute a material breach of these Terms.
5. Licence to Use the Bot
5.1 Grant
Subject to Your compliance with these Terms, the Community grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to interact with Ashley solely for Your personal, non-commercial use within the Rogue Army Discord server.
5.2 Reservation of Rights
All rights not expressly granted herein are reserved to the Community. No licence is granted to the source code, binaries, configuration, or underlying infrastructure of Ashley.
6. Acceptable Use
You agree that Your use of Ashley shall at all times be:
- in accordance with these Terms, the Community Rules, Discord's Terms of Service, and all applicable laws and regulations;
- conducted with respect toward other Community members;
- limited to the features made available to You in Your capacity as a User;
- accompanied by prompt reporting of any bug, vulnerability, or security issue discovered to the Community Administrators through the channels set forth in §19.7.
7. Prohibited Use
You shall not, and shall not permit any third party to:
- (a) exploit, hack, reverse-engineer, decompile, or disassemble Ashley, in whole or in part, save to the extent that such restriction is prohibited by applicable mandatory law;
- (b) use Ashley for any unlawful, fraudulent, or unauthorised purpose;
- (c) interfere with or disrupt the operation of Ashley, its underlying infrastructure, or the Rogue Army Discord server;
- (d) probe, scan, or test the vulnerability of Ashley without the express prior written consent of the Community;
- (e) use Ashley to transmit malware, spam, or any other harmful code;
- (f) use any automated means (including bots, scripts, or scrapers) to interact with Ashley save those expressly sanctioned by the Community;
- (g) impersonate any person or entity, or misrepresent Your affiliation with any person or entity, in connection with Your use of Ashley;
- (h) harass, intimidate, or threaten other Users through Ashley's features;
- (i) attempt to circumvent, disable, or otherwise interfere with any security-related or access-control feature of Ashley;
- (j) collect, harvest, or aggregate Personal Data relating to other Users;
- (k) use Ashley in any manner that, in the Community's reasonable judgment, brings the Community or Ashley into disrepute.
8. User Content and Feedback
8.1 Content Submitted via Ashley
To the extent that You submit any content through or in connection with Ashley (including command parameters, ticket correspondence, and voluntarily submitted information), You represent and warrant that You have all necessary rights to do so and that such content does not infringe the rights of any third party.
8.2 Feedback
You may from time to time provide suggestions, comments, or ideas concerning Ashley ("Feedback"). You hereby grant the Community a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence to use, modify, implement, and otherwise exploit such Feedback for any purpose, without obligation of attribution or compensation. You waive any moral rights in the Feedback to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
The Processing of Personal Data in connection with Ashley is governed by the Ashley Privacy Policy, which is hereby incorporated by reference. By accepting these Terms, You acknowledge that You have had the opportunity to review the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.
10.2 No Endorsement; No Liability
The Community makes no representation or warranty in respect of any third-party service and shall not be liable for any act, omission, outage, data loss, or other conduct of any such third-party provider. Your dealings with third-party providers are solely between You and them.
11. Intellectual Property Rights
11.1 Ownership
All Intellectual Property Rights in and to Ashley, including without limitation its source code, compiled code, graphics, configuration, documentation, and all derivative works thereof, vest in and shall remain the sole and exclusive property of the Community (or its licensors, as applicable).
11.2 Restrictions
Save as expressly permitted by these Terms or by applicable mandatory law, You shall not copy, modify, adapt, translate, publish, distribute, sell, rent, lend, lease, sublicense, or create derivative works based upon Ashley or any part thereof.
11.3 Third-Party Marks
All trademarks, service marks, trade names, and logos appearing in connection with Ashley are the property of their respective owners.
12. Service Availability; No Service Levels
12.1 "As Available"
Ashley is provided on an "as available" basis. The Community does not warrant that Ashley will be available at any particular time, that it will operate without interruption, or that it will be free from errors or defects.
12.2 Maintenance
The Community may perform scheduled or unscheduled maintenance on Ashley at any time. The Community shall endeavour, where reasonably practicable, to announce scheduled maintenance in the Rogue Army Discord server, but shall not be obliged to do so.
12.3 No SLA
Nothing in these Terms shall be construed as the grant of any service-level commitment, uptime guarantee, or similar undertaking.
13. Suspension and Termination
13.1 Suspension by the Community
The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User

These Terms and Conditions (the "Terms", the "ToS", or the "Agreement") set forth the terms upon which the Rogue Army gaming community ("RGA", "We", "Us", or "Our") makes available the Ashley Discord application (the "Bot" or "Ashley") to Discord users who interact with it (each, a "User" or "You").
These Terms are to be read in conjunction with, and are supplemented by, the Ashley Privacy Policy and the Rogue Army Community Rules, each of which is incorporated herein by reference.

1. Interpretation and Definitions
1.1 Definitions
In these Terms, unless the context otherwise requires, capitalised terms shall bear the meanings ascribed to them in the Ashley Privacy Policy. In addition, the following terms shall bear the following meanings:
- "Agreement" means these Terms, the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference herein.
- "Force Majeure Event" bears the meaning ascribed to it in §17.
- "Indemnified Parties" bears the meaning ascribed to it in §16.
- "Intellectual Property Rights" means all rights in and to patents, utility models, trademarks, service marks, trade and business names (including goodwill), registered designs, unregistered design rights, copyrights (including rights in computer software), database rights, rights in know-how, and all other intellectual property rights or similar or equivalent rights anywhere in the world, whether registered or unregistered, and applications for any of the foregoing.
- "Service" means the functionality made available to Users by means of Ashley, as described in §3 below.
1.2 Construction
Headings are inserted for convenience only and shall not affect construction. Words in the singular include the plural and vice versa. References to any statute, regulation, or instrument include any amendment, re-enactment, or replacement thereof.
2. Acceptance and Binding Effect
2.1 Acceptance
By interacting with Ashley in any manner, including without limitation by invoking a slash command, triggering an automated response, or being present in a channel where Ashley monitors activity, You acknowledge that You have read, understood, and accepted these Terms and agree to be bound by them. If You do not agree to these Terms, You must cease all interaction with Ashley.
2.2 Capacity
You represent and warrant that You have the legal capacity to enter into these Terms and, if acting on behalf of an entity, that You have authority to bind that entity.
2.3 Scope
These Terms govern only Your use of Ashley within the Rogue Army Discord server. They do not extend to other bots, applications, or services operated by any third party, nor to any other Discord server.
3. Description of the Service
3.1 Features
Ashley provides, inter alia, the following features:
- Activity Tracking — monitoring of User engagement and voice channel activity for the operation of the Levelling System;
- Support Systems — ticketing and user-support functionality;
- AFK Management — automatic detection and management of away-from-keyboard status;
- Game Integration — integration with third-party gaming services to enhance the Community experience;
- AI-Powered Features — limited AI-assisted functionality for improved User interaction;
- Moderation Assistance — automated tools made available to authorised Community Administrators and Moderators.
3.2 Evolution of Features
The Community reserves the right, in its sole discretion, to add, modify, suspend, or remove any feature of Ashley at any time, with or without notice and without liability to any User.
4. Eligibility
4.1 Minimum Age
You must satisfy the minimum age required by Discord's Terms of Service in Your jurisdiction of habitual residence, and in no event be less than thirteen (13) years of age, to use Ashley. Certain features reserved for Users aged eighteen (18) or over are identified in the Community Rules and related instruments.
4.2 Compliance
You must at all times comply with Discord's Terms of Service, the Community Rules, applicable law, and these Terms. A material breach of any of the foregoing shall constitute a material breach of these Terms.
5. Licence to Use the Bot
5.1 Grant
Subject to Your compliance with these Terms, the Community grants You a limited, non-exclusive, non-transferable, non-sublicensable, revocable licence to interact with Ashley solely for Your personal, non-commercial use within the Rogue Army Discord server.
5.2 Reservation of Rights
All rights not expressly granted herein are reserved to the Community. No licence is granted to the source code, binaries, configuration, or underlying infrastructure of Ashley.
6. Acceptable Use
You agree that Your use of Ashley shall at all times be:
- in accordance with these Terms, the Community Rules, Discord's Terms of Service, and all applicable laws and regulations;
- conducted with respect toward other Community members;
- limited to the features made available to You in Your capacity as a User;
- accompanied by prompt reporting of any bug, vulnerability, or security issue discovered to the Community Administrators through the channels set forth in §19.7.
7. Prohibited Use
You shall not, and shall not permit any third party to:
- (a) exploit, hack, reverse-engineer, decompile, or disassemble Ashley, in whole or in part, save to the extent that such restriction is prohibited by applicable mandatory law;
- (b) use Ashley for any unlawful, fraudulent, or unauthorised purpose;
- (c) interfere with or disrupt the operation of Ashley, its underlying infrastructure, or the Rogue Army Discord server;
- (d) probe, scan, or test the vulnerability of Ashley without the express prior written consent of the Community;
- (e) use Ashley to transmit malware, spam, or any other harmful code;
- (f) use any automated means (including bots, scripts, or scrapers) to interact with Ashley save those expressly sanctioned by the Community;
- (g) impersonate any person or entity, or misrepresent Your affiliation with any person or entity, in connection with Your use of Ashley;
- (h) harass, intimidate, or threaten other Users through Ashley's features;
- (i) attempt to circumvent, disable, or otherwise interfere with any security-related or access-control feature of Ashley;
- (j) collect, harvest, or aggregate Personal Data relating to other Users;
- (k) use Ashley in any manner that, in the Community's reasonable judgment, brings the Community or Ashley into disrepute.
8. User Content and Feedback
8.1 Content Submitted via Ashley
To the extent that You submit any content through or in connection with Ashley (including command parameters, ticket correspondence, and voluntarily submitted information), You represent and warrant that You have all necessary rights to do so and that such content does not infringe the rights of any third party.
8.2 Feedback
You may from time to time provide suggestions, comments, or ideas concerning Ashley ("Feedback"). You hereby grant the Community a perpetual, irrevocable, worldwide, royalty-free, sublicensable, transferable licence to use, modify, implement, and otherwise exploit such Feedback for any purpose, without obligation of attribution or compensation. You waive any moral rights in the Feedback to the fullest extent permitted by applicable law.
9. Privacy and Data Protection
The Processing of Personal Data in connection with Ashley is governed by the Ashley Privacy Policy, which is hereby incorporated by reference. By accepting these Terms, You acknowledge that You have had the opportunity to review the Privacy Policy. In the event of any conflict between these Terms and the Privacy Policy in respect of the Processing of Personal Data, the Privacy Policy shall prevail.
10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.
10.2 No Endorsement; No Liability
The Community makes no representation or warranty in respect of any third-party service and shall not be liable for any act, omission, outage, data loss, or other conduct of any such third-party provider. Your dealings with third-party providers are solely between You and them.
11. Intellectual Property Rights
11.1 Ownership
All Intellectual Property Rights in and to Ashley, including without limitation its source code, compiled code, graphics, configuration, documentation, and all derivative works thereof, vest in and shall remain the sole and exclusive property of the Community (or its licensors, as applicable).
11.2 Restrictions
Save as expressly permitted by these Terms or by applicable mandatory law, You shall not copy, modify, adapt, translate, publish, distribute, sell, rent, lend, lease, sublicense, or create derivative works based upon Ashley or any part thereof.
11.3 Third-Party Marks
All trademarks, service marks, trade names, and logos appearing in connection with Ashley are the property of their respective owners.
12. Service Availability; No Service Levels
12.1 "As Available"
Ashley is provided on an "as available" basis. The Community does not warrant that Ashley will be available at any particular time, that it will operate without interruption, or that it will be free from errors or defects.
12.2 Maintenance
The Community may perform scheduled or unscheduled maintenance on Ashley at any time. The Community shall endeavour, where reasonably practicable, to announce scheduled maintenance in the Rogue Army Discord server, but shall not be obliged to do so.
12.3 No SLA
Nothing in these Terms shall be construed as the grant of any service-level commitment, uptime guarantee, or similar undertaking.
13. Suspension and Termination
13.1 Suspension by the Community
The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:
- Community Support Server: https://dc.roguearmy.xyz
- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

10. Third-Party Services
10.1 Integrations
Ashley integrates with third-party services, including without limitation Discord, OpenAI, and Ubisoft. Your use of features that rely upon such integrations is subject to the respective terms and privacy policies of those providers, in addition to these Terms.

The Community may, in its sole discretion and without prior notice, suspend or restrict Your access to Ashley (in whole or in part) where:
- (a) the Community reasonably suspects a breach of these Terms, the Community Rules, or applicable law by You;
- (b) continued access poses a security or integrity risk to Ashley, the Community, or other Users;
- (c) required by applicable law, regulation, or order of a competent authority.
13.2 Termination by the Community
The Community may terminate Your right to use Ashley at any time, with or without cause, by notice given through the Rogue Army Discord server or by removal of Your access.
13.3 Termination by the User
You may terminate these Terms at any time by ceasing all interaction with Ashley and, if desired, submitting an erasure request in accordance with the Privacy Policy.
13.4 Consequences of Termination
Upon termination:
- (a) Your right to use Ashley shall cease immediately;
- (b) accrued rights and obligations of the parties shall remain unaffected;
- (c) the provisions of §§ 7, 8.2, 11, 14, 15, 16, 19, 20, and 21 shall survive;
- (d) the Processing of Your Personal Data post-termination is governed by the Privacy Policy.
14. Warranties and Disclaimers
14.1 No Warranty
To the maximum extent permitted by applicable law, Ashley is provided "as is" and "as available", without warranty of any kind, whether express, implied, statutory, or otherwise. The Community specifically disclaims all implied warranties of merchantability, fitness for a particular purpose, non-infringement, accuracy, and uninterrupted operation.
14.2 No Reliance
You acknowledge that You have not relied upon any representation, warranty, or statement made by the Community that is not expressly set out in these Terms.
14.3 Mandatory Rights
Nothing in this §14 shall exclude, restrict, or modify any warranty, right, or remedy conferred upon You by applicable law that cannot, as a matter of law, be excluded, restricted, or modified.
15. Limitation of Liability
15.1 Exclusion of Indirect Loss
To the maximum extent permitted by applicable law, the Community shall not be liable to You for any indirect, incidental, special, consequential, exemplary, or punitive loss or damage, including without limitation loss of profits, loss of data, loss of opportunity, loss of goodwill, or loss of anticipated savings, whether arising in contract, tort (including negligence), breach of statutory duty, or otherwise, and whether or not the Community had been advised of the possibility of such loss or damage.
15.2 Aggregate Cap
To the maximum extent permitted by applicable law, the total aggregate liability of the Community arising out of or in connection with these Terms or Your use of Ashley, howsoever caused, shall be limited to zero euros (€0.00).
15.3 Gratuitous Nature of the Service
You acknowledge that Ashley is provided free of charge and that the limitations set forth in this §15 reflect a fair and proportionate allocation of risk in light of the wholly gratuitous nature of the Service and the absence of any consideration flowing from the User to the Community.
15.4 Non-Excludable Liability
Nothing in these Terms shall exclude or limit the liability of the Community for: (a) death or personal injury caused by its negligence; (b) fraud or fraudulent misrepresentation; or (c) any other liability that cannot, as a matter of law, be excluded or limited.
16. Indemnification
You agree to indemnify, defend, and hold harmless the Community, its Founders, Community Administrators, Moderators, and members of the Ashley Development Team (the "Indemnified Parties") from and against any and all claims, liabilities, damages, losses, costs, and expenses (including reasonable legal fees) arising out of or in connection with:
- (a) Your breach of these Terms, the Community Rules, the Privacy Policy, or any applicable law;
- (b) Your infringement or alleged infringement of the rights (including Intellectual Property Rights) of any third party;
- (c) any content You submit through or in connection with Ashley;
- (d) Your wilful misconduct or gross negligence.
The Community shall promptly notify You of any claim for which indemnification is sought and shall cooperate, at Your expense, in the defence thereof. The Community reserves the right to assume exclusive defence and control of any matter subject to indemnification.
17. Force Majeure
Neither party shall be liable for any failure or delay in the performance of its obligations under these Terms to the extent that such failure or delay is caused by a Force Majeure Event, being any event beyond the reasonable control of the affected party, including without limitation acts of God, war, terrorism, civil unrest, pandemic, governmental action, interruption of internet services, power failure, denial-of-service attack, failure of a third-party provider (including Discord), or natural disaster. The affected party shall give prompt notice of the Force Majeure Event and shall use commercially reasonable efforts to mitigate its effects.
18. Amendments
18.1 Right to Amend
The Community reserves the right to amend these Terms at any time. Material amendments shall be announced in the Rogue Army Discord server not less than seven (7) days prior to their taking effect, save where immediate amendment is required for legal, regulatory, or security reasons.
18.2 Continued Use
Continued interaction with Ashley following the effective date of an amendment shall constitute acceptance of the Terms as amended. Users who do not accept an amendment shall cease interaction with Ashley.
19. Miscellaneous
19.1 Severability
If any provision of these Terms is held to be invalid, illegal, or unenforceable, the remaining provisions shall continue in full force and effect, and such invalid, illegal, or unenforceable provision shall be deemed replaced by a valid, legal, and enforceable provision that most closely reflects the original intent of the parties.
19.2 Entire Agreement
These Terms, together with the Privacy Policy, the Community Rules, and any other instrument expressly incorporated by reference, constitute the entire agreement between the Community and the User in respect of the subject matter hereof and supersede any prior representations or understandings, whether oral or written.
19.3 No Waiver
No failure or delay by the Community in exercising any right, power, or remedy under these Terms shall operate as a waiver thereof, nor shall any single or partial exercise of any such right, power, or remedy preclude any further exercise thereof.
19.4 Assignment
You may not assign, transfer, or sublicense any of Your rights or obligations under these Terms without the prior written consent of the Community. The Community may assign or transfer its rights and obligations hereunder without Your consent.
19.5 No Third-Party Beneficiaries
A person who is not a party to these Terms has no right under the Contracts (Rights of Third Parties) Act 1999 or equivalent legislation to enforce any term hereof, save that the Indemnified Parties shall be entitled to enforce §16 in their own right.
19.6 Relationship of the Parties
Nothing in these Terms shall create any partnership, joint venture, agency, employment, or fiduciary relationship between the Community and the User.
19.7 Notices
Notices from the Community to Users may be given by posting in the Rogue Army Discord server, by publication in the Wiki, or by any other reasonable means. Notices from Users to the Community shall be given through:
- Community Support Server: https://dc.roguearmy.xyz
- Support Ticket Channel: the ticketing system within the Rogue Army Discord server
19.8 Survival
Any provision of these Terms that by its nature should survive termination shall so survive.
19.9 Language
These Terms are executed in the English language. Any translation provided for convenience shall not be authoritative; in the event of any discrepancy, the English version shall prevail.
20. Governing Law and Jurisdiction
These Terms shall be governed by and construed in accordance with the law of England and Wales, without regard to its conflict of laws principles. The courts of England and Wales shall have exclusive jurisdiction over any dispute arising out of or in connection with these Terms, save that a User may, where required by mandatory provisions of applicable consumer law, bring proceedings before the courts of their jurisdiction of habitual residence. Nothing herein shall affect the User's mandatory statutory rights under the law of their habitual residence.
21. Dispute Resolution
21.1 Informal Resolution
The parties shall endeavour to resolve any dispute arising out of or in connection with these Terms by good-faith informal negotiation in the first instance. Such negotiation shall be initiated by written notice describing the nature of the dispute, addressed to the contact set forth in §19.7.
21.2 Formal Proceedings
If the dispute is not resolved within thirty (30) days of such notice, either party may commence proceedings in the courts designated in §20, without prejudice to any right to seek urgent injunctive or equitable relief.

By continuing to interact with Ashley, You acknowledge that You have read, understood, and agreed to be bound by these Terms, together with the Ashley Privacy Policy and the Rogue Army Community Rules.
